Eligibility Criteria:
Eligibility criteria for the Temporary Foreign Worker Program include:

– Job Offer from Canadian Employer: Foreign workers must have a valid job offer from a Canadian employer who has obtained a positive Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada (ESDC).

– LMIA Requirement: Employers must demonstrate that hiring a foreign worker will not negatively impact the Canadian labor market and that efforts have been made to recruit Canadian citizens or permanent residents for the position.

– Work Permit Application: Once a positive LMIA is obtained, foreign workers can apply for a work permit to work in Canada temporarily.

Application Process:

The application process for the Temporary Foreign Worker Program typically involves the following steps:

1. Employer Applies for LMIA: Canadian employers submit an application for an LMIA to ESDC, demonstrating the need to hire a foreign worker and outlining the terms and conditions of employment.

2. LMIA Processing: ESDC assesses the employer’s application, considering factors such as the availability of Canadian workers, wages and working conditions, and the potential impact on the Canadian labor market.

3. Positive LMIA Issuance: If the application is approved, ESDC issues a positive LMIA to the employer, indicating that hiring a foreign worker is justified based on labor market considerations.

4. Foreign Worker Applies for Work Permit: With a positive LMIA in hand, the foreign worker applies for a work permit through the Immigration, Refugees, and Citizenship Canada (IRCC) online portal or at a Canadian visa office in their home country.
